  1. RECITALS
    The owner and manager of the Website www.netsaddle.com (the “Site“),(the “Website”), as well as the provider of the services rendered by it, is Selle Italia S.r.l., with registered office in Casella d’Asolo (TV), Italy, at Via Enrico Fermi No. 2, corporate capital of € 1,300,000 fully paid-in, registered with the Register of Companies of Treviso, under REA No. 330199, Tax Code and VAT No. 00652320243 (“Selle Italia”).

    Selle Italia invites all users of the Website (the “Users”) to read this regulation (the “Regulation”) before using the Website and the Services offered by it.

    The use of the Website entails in itself the acceptance of the Regulation by the User, without the need for his/her formal consent to same.

    The Regulation may be amended, at any time, by Selle Italia. It is understood that the applicable Regulation is that appearing on the Website, at the time of the User’s access.

  2. WEBSITE FUNCTIONALITY
    The Website is a platform whereby Users can be acquainted with the assortment of Selle Italia products (the “Products”) and purchase them.

    Selle Italia reserves the right to add or remove features of the Website, either temporarily or permanently, without prior notice to and without the consent of the User.

  3. USE OF THE WEBSITE
    Use of the Website is reserved to adults (i.e., at least, 18-year old) and underage people only if authorized by a parent or guardian.

    Not having the possibility to independently assess the identity of those using the Website, Selle Italia recommends anyone who has the responsibility of a minor to monitor the Website use by same.

    Access to certain Website services may be subject to the creation of an account. For this purpose, Users may be required to provide certain personal data, for identification and access to the Website.

  4. BEHAVIOR ON THE WEBSITE
    Users must refrain from:

    • committing illegal acts through the use of the Website;

    • extracting, copying or using – for purposes other than browsing the Website – data or content of any kind which may be available on the Website;

    Users may, at any time, notify Selle Italia that they no longer wish to receive the Website’s newsletter and they wish to be deleted from any mailing list related to it, by clicking on the relevant link at the bottom of the received newsletters.

    Further to registration of the account, the Website may send to the User service e-mails related to account information, purchases made, updates of the Website and related services, commercial materials and promotional offers. Users may decide, at any time, that they no longer wish to receive commercial material and promotional offers by clicking on the relevant link at the bottom of the e-mails received.

    Selle Italia does not warrant that the Website is virus-free or immune of other contaminants that may damage the electronic devices used by the User to connect to the Website, or the software installed in such devices. Therefore, Selle Italia recommends that Users apply appropriate security tools, in order to prevent any possible contamination by using the Website.

  6. SUSPENSION OF SERVICE AND RESOLUTION
    Access to the Website may be suspended, limited or discontinued, at any time.
    Selle Italia also reserves the right to filter and remove any material that, at its sole discretion, may be contrary to the Regulation or, in any case, not conforming to the purposes of the Website and the services offered through it.

    Selle Italia also reserves the right to terminate the accounts of those who violate the Regulation and behave in a manner that does not conform to the purposes of the Website and the services offered through it.

  7. PERSONAL DATA AND COOKIE POLICY
    Selle Italia recommends that Users consult the Privacy Policy and the Cookie Policy before registering their account and using the Website.
  8. INTELLECTUAL PROPERTY
    All rights related to the Website and the material and information contained therein belong to Selle Italia and are reserved.

    In particular, without limiting the generality of the foregoing, Users are hereby informed that all industrial and/or intellectual property rights (such as copyrights, patents, trademarks, designs, domain names, know-how, software or database) relating to the Website or the materials and information contained therein (such as texts, graphics, photos, videos, music, sounds and source codes – collectively, the “Contents”), both registered and unregistered, belong to Selle Italia or, in some cases, to third parties that allow Selle Italia to use them.

    Selle Italia grants to the Users the right to use, without any exclusivity, the Website. The Users are aware of, acknowledge and agree not to be entitled to any further right in respect of the Website and the Contents, which shall not be used by them in any way, except as provided in this Regulation.

  9. LIABILITY
    Use of the Website is under the sole responsibility of the User.

    Selle Italia is exonerated, to the fullest extent permitted by law, from any liability for damages that Users may be suffer due to access, non-access or use of the Website and the Contents.

    Users are informed about the possibility that Selle Italia may temporarily suspend access to the Website for technical reasons or even just for opportunity reasons, and waive as of now any complaints about this.

    Under no circumstances, Selle Italia will be responsible for:

    • any malfunctions in the network that do not allow the correct access or operation of the Website;
    • any loss of data;
    • any software malfunctions;
    • any consequences of computer viruses, bugs, faults or malfunctions.

    Users agree to keep Selle Italia harmless from any liability, damage, loss, cost, expense or burden, whether direct or indirect, that Selle Italia may incur in connection with:

    • any breach of this Regulation by the User; or
    • any activity of the User that does not comply with this Regulation, the purposes of the Website and the services offered in it.
  10. APPLICABLE LAW AND JURISDICTION
    This Regulation and the relationship between Selle Italia and the Users with reference to the use of the Website and the Contents are governed by Italian law.

    Any dispute arising out of this Regulation, its validity, effectiveness, enforceability, interpretation and execution or otherwise relating to the relationship between Selle Italia and Users, in relation to the use of the Website and the Contents, will be subject to the exclusive jurisdiction of the courts of Treviso (Italy).
